The Frontier Crime Regulation(FCR) comprise a set of laws enforced by the British Raj in the pushtun inhibited tribal areas. They were specially devised to counter the fierce opposition of Pakhtuns to British rule,and their main objective is to protect the interest of the British Empire.The FCR date back to the occupation of six Pakhtuns-inhibited districts by British in 1948.The regulation was re-enacted 1873 and again in 1876 with minor modifications.
With the passage of time,the regulations was found inadequate and new acts and offences were adopted to extend it scope.This was done through promulgation of the frontier crime regulations 1901.
The political agent was the master of the agency and the final authority of decision making in the area.Even today his authority is unchallenged and power unrestricted.
Artical 40 of the FCR allows the political administration to punish the whole tribe for the crime of the single person.He performs all functions including executive and judicial power,that directly affect the individual and collective rights of the tribal people.It is a mixture of of traditional customs and noms with executive direction. Indeed the British devised this as an instrument for subjugating the tribesman.
According to FCR despite the presence of popularly elected tribal representative, Parliament can play no role in the affairs of the area.Artical 247 of the Pakistani constitution provide that no act of parliament applies to the Fata,unless the president desires.Only the president is authorized to amend laws and promulgate ordinance of the tribal areas.After taking vote of confidence on 29 march 2008,the Prime Minister of Pakistan
Yousaf Raza Gilani expressed his GOVT desire to repeal FCR.Following this procession,their have been large number of processions in favor of this decision.
But unfortunately the tribals have been treated under this in human law(FCR)still now.
So we strongly condemn The FCR and have demand from Pakistani Governmental to repeal the FCR from the Tribal areas of Pakistan.

Thanks Auranzeb Khan for such an informative input regarding FCR especially its worst artical no.40, that authorizes the Political Agent for the particular Trible district to punish the whole tribe for the wrong doings of even a single person.

The worst scenario was observed and even could be seen today when the powers some how came to hands of Military in the region.
PM Gilani makes many promises and giving tall statements to make people feel good.
But, this personality really disappointed me when wikileaks revealed about his stance on drone attacks he had expressed to the US Ambassidor in Islam abad.
I think the main problem in Trible areas is the lack of awarness, that our people are uneducated and our rulers are exploiting them.
Funny thing is that, the people who we send to our National assembly also forget Waziristan and the promises they do with waziristanis, no prominant move can be quoted from the members in Senate or national assembly on the long standing issues with trible people, they just get themselves elected and sale their loyality for their personal benifits.
